These Terms of Use (the "Terms") govern your access to and use of the Mollario mobile application and related services (collectively, the "Service"). The Service is provided by Mollario Team ("Mollario Team", "we", "us", or "our").
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) Eligibility (17+)
You must be at least 17 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2) The Service
What Mollario does
Mollario is your pocket-friendly companion for capturing and organizing the beauty of flowers. The Service may allow you to:
- Take or import photos of flowers and organize them in a searchable library
- Add voice notes and annotations to entries
- Apply simple photo adjustments
- Compile entries into a digital journal
We may update, change, suspend, or discontinue any part of the Service at any time.
3) Accounts
You may need to create an account to use certain features. You agree to:
- Provide accurate information and keep it up to date
- Keep your login credentials confidential
- Notify us promptly if you suspect unauthorized access
You are responsible for activity on your account to the extent permitted by law.
4) Your Content
Ownership. You retain ownership of the photos, voice notes, text, and other materials you submit or create through the Service ("User Content").
License to Mollario Team. To operate the Service, you grant Mollario Team a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and use your User Content solely to provide, maintain, and improve the Service and to carry out the specific actions you request (for example, generating an export). This license ends when your User Content is deleted from the Service, except for limited copies retained for legal, security, and backup purposes for a reasonable period.
Responsibility. You are responsible for your User Content. You represent and warrant that you have all necessary rights to submit User Content and that it does not violate any law or third-party rights.
5) Prohibited Conduct
You agree not to:
- Use the Service for illegal, harmful, or abusive purposes
- Infringe or violate intellectual property, privacy, or other rights
- Upload malware or attempt to disrupt, damage, or interfere with the Service
- Attempt to gain unauthorized access to accounts, systems, or networks
- Reverse engineer, decompile, or attempt to extract source code except where permitted by law
- Use automated means to access the Service in a way that burdens or harms it
6) Privacy
Your use of the Service is also subject to our Privacy Policy (provided separately). Please review it to understand how we collect and use information.
7) Intellectual Property
The Service, including its software, design, and branding, is owned by Mollario Team and its licensors and is protected by applicable intellectual property laws. Except as expressly permitted, you may not use our trademarks or copy, modify, distribute, sell, or lease any part of the Service.
8) Third-Party Services and Devices
Your use of the Service may involve third-party services (such as your device operating system, app marketplace, or network provider). We are not responsible for third-party services, and your use of them may be subject to their terms and policies.
9) Apple App Store Additional Terms
If you use the Service on an Apple iOS device:
- These Terms are an agreement between you and Mollario Team, not Apple.
- Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support services.
- Apple is not responsible for addressing claims relating to the Service or your possession/use of the Service, including product liability, legal compliance, or consumer protection claims.
- For third-party intellectual property infringement claims, Mollario Team (not Apple) is solely responsible for investigation, defense, settlement, and discharge.
- You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government prohibited or restricted party list.
10) Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOLLARIO TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO MOLLARIO TEAM FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $10 IF YOU PAID NOTHING).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Mollario Team from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from or related to your User Content, your use of the Service, or your violation of these Terms.
13) Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms or if needed to protect the Service, users, or Mollario Team.
14) Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of the principal place of business of Mollario Team, without regard to conflict of law rules.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, except that either party may bring a claim in small claims court if eligible. To the extent permitted by law, you and Mollario Team waive any right to participate in a class action or class-wide arbitration.
15) Changes to These Terms
We may update these Terms from time to time. If we make changes, we will update the Effective Date above. Your continued use of the Service after changes become effective means you accept the updated Terms.
